Hi Miss. Sugapriya,
As per government rules it compulsory for all employees who is working in our organisation.. Now the ESI limit is 21000. Who all are getting more than 21000 is not applicable for ESIC.

1. Dear member, coverage under both Acts namely- EPF & MPs Act, 1952 and ESI Act, 1948 are separately decided and are not dependant on each other. The departmental authorities are also different. However, In Delhi, the threshold of coverage under ESI Act, 1948 is employment of 10 or more persons in factories or selected notified establishments. Whereas, I think, in EPF, the threshold for coverage is engagement of 20 or more persons. Therefore any factory or establishment is required to be covered on the basis of 10 or more persons i.e. even prior to the coverage under EPF.

2. However, in respect of coverage under ESI Act, the coverage is subject to the area been declared as implemented area, whereas, there is no such condition in EPF.

3. In order to avoid any error in decision of coverage, it will be more better if you may contact ESI authorities of your area and ascertain the position regarding coverability or otherwise of the establishment in which you are working. Hope this will avoid penalties and damages, if it is found later on that the establishment/factory was required to be covered retrospectively.

Since you are covered under PF,it means you have 20 or more employed persons.So ESI is applicable to you,if your establishment is situated in the area where the ESI Act is implemented.

I would also like to add that for coverage of the establishment the quantum of wages being paid to employees has no relevance. If you employ 10 or more employees you are under ESI coverage provided your establishment is situated in an implemented area, even if all are being paid more than Rs 21000.
