Dear All,
We are giving Minimum wages as per rule 2016-2017, Just this month only we are given PA to every employees. Now My company Minimum wage for Men is 8500 + OT, Womens 6500 + OT and other allowances.
Now the government has increased Minimum wages from 6500 to 10000.
How we can manage this problem.

Dear Mr Nagarjun,
You yourself have stated that you are giving Minimum Wages as per Notification for the year 2016-17.Please clarify about your Statement, we have given "PA to every Employee"
Please do not consider "OT" for the purpose of payment of Minimum wages.OT is paid for work beyond stipulated Hours/Extra Working.Why there is difference of rs2,000/- between Men & Women Employees in violation of Equal remuneration Act, 1976.Please follow Minimum Wages Notification applicable to your industry for the year 2017-18

Dear MR. SRINATH SAI RAM,
We can give maximum 15% for Salary Increment. But government has increased Minimum Wages from 6800 to 10100. How we can give more than 40% for salary hike.
We have around 250 employees if every employees we have to give then the salary paid will be high. It will be very difficult.

Oil & Gas Industries are not classified under Scheduled Employment as regards to The Minimum Wages Act, 1948 (Central) and are governed under Central Rules:

My question is the Service Agency (Contractor) who is carrying out Operations & Maintenance job (Pipelines Maintenance) will fall under which category of industry for payment of MW?

The following Industries are classified as Scheduled Employment under The Payment of Minimum Wages Act, 1948 (Central)

1 Agriculture

2 Mines

3 Construction / Maintenance of Roads and Building Operations & Runways.

4 Employment in laying of underground electric, wireless, radio, television, telephone, telegraph and overseas communication, cables and similar other underground cabling, electric lines, water supply lines and sewerage Pipelines.

5 Loading & unloading in Goodsheds, Parcel offices of Railways, other Goodsheds, Godowns, warehouses and Docks & Ports.

6 House Keeping (Sweeping & Cleaning)

7 Watch & Ward (Security)

Agency is not carrying out any activities of Construction / Maintenance of Roads and Building Operations & Runways in client's premises but doing maintenance for their Stations & Pipelines in multiple states.

The client is insisting to pay the Minimum Wages as per the "Construction / Maintenance of Roads and Building Operations & Runways" Is it correct?

As far as my knowledge there is a provision under the MW for classification of Industries known as

Residuary Factories OR

Registered Factories which are not covered under any Classified Scheduled Employment. And the Minimum Wages defined under this industry is payable to workmen.

Request you to kindly look into it and advise accordingly.

Dear Mr. Nagarjuna,
The goverment declares minimum wages based on the cost of living index. The minimum wage indicates that is the minimum amount required for survival. Not giving minimum wage will attract penal provisions and it amounts to exploitation. The issue is not of percentage. The very fact that you have had different wages for Men and Women employees shows that you have violated the equal remunaration act of 1976. If you want to be law abiding, then you have to comply with the statutory provisions, and in this case it is providing minimum wages. If not, you will face prosecution and attract penal provision. That will prove very costly for your company.

Why OT payment is included for the purpose of payment of Minimum Wages.As per the notifications attached by you, Minimum Wages are applicable from 01/04/2016 to 31/03/2017.Please follow minimum Wages applicable from 01/04/2017 to 31/03/2018.

Dear Mr.SRINATH SAI RAM,
If i wants to match current minimum wages then company will go loss only. Why because every month extra 5lacs to 6 lacs we have to pay. How i can avoid loss?
We are no into big gaining company, Our Industry is Co-Packing Industry. So we are getting 2-3% margin only.
We have conducted meeting. In that If we increase ladies wages then again we have to increase men wages also. It will be very difficult for us. Still we are not cleared what we are going to do.

Dear Mr.SURESH2511,
Oil and gas Industry is separate industry for this industry also Minimum Wages applicable. Check with competitor company or other Oil and gas Industry.
We are not aware of Oil and Gas Industry.

Dear Nagarjun,
Thanks for your suggestion. However, this question was specifically for Shri Umakanthan M. as he is Retired Additional Commissioner of Labour and will be in a position to throw some light on the subject. And of course the query is for few Senior Members.
Many Members have viewed this Post from 6th April, 2017 but not a single one has commented on it to my satisfaction.
I am confident that the industries which are not classified as Scheduled Employments are covered under Residuary Factories for Payment of Minimum Wages, but Oil & Gas definitely not falling under the Category of Construction / Maintenance of Roads and Building Operations & Runways.
