I had put my resignation on 09-11-2016 and as per terms of appointment my notice period was one month. Accordingly I asked to relieve me on completion of notice period i.e., on 08-12-2016. But they released me on 30-11-2016 without my consent. I have not asked any reduction of my notice period. Now I have claimed 8 days notice pay as they have terminated during my notice period but they are not paying me the same. CanI approach for legal action? If so, how? Please advise.

As per the employment agreement you are supposed to give one month notice to the employer, wherein the employer must have found a suitable candidate for your replacement within 20-22 days so the employer must have relieved you beforehand so legal will not help you much in this regard. Secondly the amount of 8 days will not suffice your time and money spend on legal to the best of my knowledge. Hence it is advisable to move on with your new assignment
