Dear All,

I have resigned company B in Dec 2006. Actually I left Comp A in Aug 06 and joined Company B in Sep 06. Then i did not like the environment and health was going bad. I had discussed with HR and Manager about my situation and they accepted my resignation. When I asked them to give me releasing letter and Exp letter. They have sent me final settlement amount. Actually I have taken reallocation amount when i joined in Comp B.According to offer letter I suppose to give back if i leave company before one year. I haven't pay anything to company and did not collected any letter. I am currenty working in abroad. My question are :

1) I want to withdraw my PF ( I have already transfer my company B PF to new account in Comp A, I have only PF account Number). Form 19 require employer signature, if employer does't agree to sign then what shall i do? Can employer hold the PF amount?

2) Will I get full PF amount (emlpyee and employer contribution)? Is it any problem withdrawing after a year time?

3) Can you guide me procedure?

4) Can employer hold my Form 16 & TDS in the case of non F & F settlement?

Sorry for too many question. Please help me badly?

Dear Diwakar,
the company cannot refuse you your PF money. Please understand that these are statutory issues which all companies are bound by. Fill out all the required forms. Even if it is 1 year late there is no problem. Once you have submitted the forms it might take upto 2 months on the higher side for the money to be transferred.
