Hello Sir/Madam,
I am working with a Service Provider company as an Asstt. Store Manager. In our company company it is mandatory to work 24 days to get 04 weekly holidays. If someone is present for 23 days then he will be eligible to get only 03 weekly holidays. Now I want to know that is it the right way to reduce 01 weekly holiday as a penalty when you have worked 05 days in a week. After how many working days I can take my weekly holiday ???????? Please guide .

I think that the Shops and Establishments Act of the State is applicable to your establishment including its branches, warehouses situated elsewhere. Generally, every person employed in an establishment shall be allowed in each week a holiday of one wholeday subject to the condition that the individual's total period of employment in the week, INCLUSIVE OF THE DAYS SPENT ON AUTHORISED LEAVE, is not less than six days. There is also a provision empowering the State Govt to declare an additional holiday of half a day in a week by special notification. So, what is important is that the employee's working days in a week including authorised leave should be not less than six days to get a paid holiday on the seventh day. Better, refer to your State's Shops and Establishment Act.
