Hi all,
I am an ex-employee of a company. I worked with them for 3 months. in my appointment letter its mentioned that i need to serve 45 days notice or i need pay notice pay lieu for 45 days.
As per appointment letter i need to pay 28500 rupees but i discussed with director and agree to pay 10000. so i took some to pay and i paid 10000 on 2/9/2014. but still i did not get my relieving letter and HR people are not responding to my calls or emails.
Please suggest me what i can do, because i need to submit my relieving letter to my current employer. Am i eligible for applying PF(provident fund) from my previous employer?

What documentation do you have of the company accepting your short notice ?
Do younger a receipt or acknowledgement of paying them ₹10000 ?
You can always explain to your new employer of the problem and ask them what documents you can give in place of the relieving letter.
However, most people will not bother even to quote a 3 month job experience as it looks bad in the cv. So will your new company accept the relieving letter from the previous employer ?

Hi,
I do not have any receipt or acknowledgement for the payment. But i have all the recording about discussion what ever happened between director and HR.
Is it possibility provide me reliving letter format mentioning about notice pay. I am not going to mention 3 months experience in my CV, but as i already inform to my current employer i need to submit it. My present company asking for relieving letter or email from HR about notice pay.
Am i eligible for applying PF, because i worked with them only 3 months?

First, what is recording ? A voice recording ? Or on email ?
If it is voice recording, HR in new company will not accept it. Because they can not keep it on record. Besides, there are rules against recording conversation without consent.
If it is writing / email, it will be good to share that with the new employer.
However, I still do not understand how you do not have any evidence of having given so much money. I hope it was paid in cheque, so you can show th bank statement to your employer.
There are lots of formats of relieving letter, both on this forum and on Google. You can select any of them. It would not be a good idea to mention short notice on the relieving letter but to get a clean exit. Future employers are not going to be concerned of whether you paid them for notice, but just that you were relieved properly.
As for PF, it's better that you transfer your PF to the new company. It can be done online and no longer needs approval of previous employer.
