Hi,
I have resigned the Organisation on 4th Sep'18 serving 15 days notice period. I have extensive travelling due to which I m getting health issues and on this bases I told them that will pay recovery amount but please relieve me. My HR is threatening me that she will abscond and terminate me if I not served 45 days notice period.
Kindly suggest as relieving letter is important for my carrier

U should have to servive notice period,but if u are unable to continue
u can request the hr person and ask him/her for ur full and final settlements
and ask him that u are ready to pay notice period charges..in this case as per company policies
if the employee could not servive the notice period he/she should have to pay to company for left days(notice period)

I have already given in writing that I will pay back the amount of recovery but since that also I m being forced to serve 45 days notice period and if failed to do so she will show me absconding and terminated and will not release my relieving letter.
I m being threated with this.

Hi Sunita,
Your HR is only trying to show her angst on replacement issue. Otherwise as you have stated that due to extensive travel and correlated medical reasons you are quitting, accepting to buy back the notice period was not being digested by her.
May be replacement is the only issue to her,kindly approach her one more time or else then her superior and get the clearance accordingly.

Convey your reply that due to health issues, you can complete the notice period but can not be able to handle outdoor travel work, so ready to serve the notice period on ground work or office work .....
let them decide next

Dear Colleague,
If there is condition in the appointment letter that notice period or salary payable by either party, then I fail to understand insistence of notice by HR.
However, now that you want to quit on health grounds, you better serve 45 days notice period to satisfy idiosyncrasy of HR and quit on good note.

It would be better if you take an appointment with the HR and try to sort out the issue across the table with all the supporting docs like medical history and issues cropping up due to frequent travel etc. This might help in convincing the HR that it is a genuine case else it will be better you go by the contract of employment and get the relieving letter as the same is important for your career. There is no point in confrontation as you have decided to quit and want the letter.

Hi Sunita,
If you are genuinely leaving because of health reasons, get a doctor to certify it. Attach the certificate with your resignation and get the same delivered to HR and obtain an acknowledgement.
Also write another letter address to HR with CC to your MD. requesting permission to quit without completing the notice period and your willingness to give 1 months salary in lieu of notice.

i have resigned from the company and served the 1 week notice and had a discussion with HR regarding 1 week notice buy out but they have sent an email to me for absconding although they haven't given me conformation.
