Can a person is liable to receive bonus or incentives while serving his notice period.
In our company marketing team gets commission on sale will they be liable to receive even during their notice period.

Dear Rashmi,
It is as per company policy, but, logically, performance bonus & incentive is based on performance respective whether you are on notice period or not..?
if your performance is up to the mark & meetting the criteria of said policy then, company should be pay out.

Thanks a lot for your answer but here situation is this that this is not mentioned in the agreement that benifit will be provided or not.

Dear Rashmi,

Please note that all rewards of the nature mentioned by you are being given for past work and performances. Even if the person concerned is going he should get the benefit as per me. According to me by doing this a company sends out fair play signals, has better chances of longer retention and more engaged employees. New employees also get attracted to join because of the demonstrated fair play.

However, the flip side to be considered is that the company has limited resources, The bonuses and rewards are given to employees for motivation and retention. If an employee has already made up his / her mind to leave ( and the person leaving does go at an improved salary) Then why not use the resource for the existing employees. This approach encourages employees to announce separations post the increment disbursal. There are numerous examples of exodus after the increment period.

Legally the bonus amount is supposed to be paid to an ex employee if he satisfies the legal requirements. By bending the rules for the non unionized employees we are encouraging them to become dissatisfied or form associations etc. for better bargaining power.
