Legal notice is to be issued by an enrolled advocate, otherwise it will not be legal notice as per requirement. So pl consult an Advocate and instruct him/her to issue the notice

Yes. But as an employer, you can send an Official letter, directing him to return company property. Still if he did not return the same after a reasonable time, then you can initiate legal advice to him through a learned Advocate.
