Yes the employee is eligible for the gratuity. The employee should receive gratuity assuming he has worked till retirement (subject to maximum ceiling of Rs. 10 lakhs)

Can you please provide me with the section which states that we have to calculate gratuity upto date of retirement in the event of death.
As per my knowledge the next of the kin would receive the gratuity for the actual period worked and not the assumed period.
So if a person aged 25 expires while working for an organisation with 60 years as retirement age after completing 2 years of service the nominee will get gratuity worth 2 years only and not for the remaining 35 years.

no where in the gratuity act that death of employee while in service will entitle to be paid upto retirement age.of course expect in case the employees gratuity is linked with lic by employer on their own

Dear Santhosh, the Employee is eligible for Gratuity in case of Death till the retirement age . In case of employee Resigns after completion of 5 or more than years then he is eligible for gratuity in case of resignation
