Under BOCW who shall be responsible for taking registration under the Act, Whether main Contractor or Sub-Contractor under the umbrella of Main Contractor ?

But the main contractor insisting us to get the registration under BOCW,what is the remedy for the same.

In my view, the contractor should get the BOCW licence. As he has to bare 1% cess on total contract value. If the contractor gives his work to sub contract (part of the work or whole work), if the sub contractor works behalf of main contractor (which mean, the sub contractor may not exist in the principal employer view) , this point of time the sub contractor no need to get BOCW other vise even the sub contractor should get the BOCW license

As per BOCW Act the Principal Employer for whose benefit the construction activity is being undertaking is liable to register with the BOCW Deptt. He can deduct if contract clause permits so from the contractor labour cess @1%. All basic facilities to labour viz.firstaid box, water, sanitation, gum boots, hand gloves, safety belts etc. must be provided by the Contractor. Also sufficient safety measures such as Fire Fighting equipments,gaurds to Mixer Machines, barricading all equipments where some sort of accident may occure should be taken. Besides, testing certificates of equipments should be obtained. .Hope, it will help you a lot. Thanks.
