I am on rolls with a organisation since last 3 years and still on roll at a senior posistion .
From july 2013 salary were delayed and now situation is there is a backlog of 5 months .
Form 16 is not issues and TDS tax is also not paid.to the IT

By senior position I understand that you are in managerial position and if so you will not get protection of Labour Laws but you have to fight the matter as a civil case on the ground of violation of contract. For workers, naturally, the provisions of Payment of Wages Act would help go to recover the amounts due from the employer.
