What should be a model draft for a letter of loss of confidence in an employee by the Management and how should the management proceed in such a case of loss of confidence ?

Dear Maneeshishri,

What is the background of the case? Why you lost confidence on that employee? Do you have sufficient evidence for the "misconduct" by that employee?

Depending on the gravity of misconduct, you can initiate appropriate disciplinary action. Mere saying that you lost confidence on certain employee and to issue some letter does not go well.

Yes, you may say that Maruti Suzuki Motors Limited (MSML) had terminated hundreds of employees on the grounds of "loss of confidence". However, their case was different. Certain section of employees had vandalised the company property and one senior management personnel was killed also. The employees who were terminated were on duty that time and they were mute spectators to the vandalism and hooliganism of few employees.

We do not know what has happened in your case. However, while dealing with misconduct it is important to follow progressive discipline. Have you done that?

Loss of confidence can be resorted as a last step only. In the case of workers the disciplinary action can be taken based on the CSO and as per principles of natural justice. Any disciplinary procedure should proceed in stages from warning, fine and then issuance of show cause notice leading to suspension after proper enquiry When loss of confidence is thought, the employee forfeited consideration of employment with the Mgmt. The loss of confidence letter should be a speaking order giving details of opportunities given to the employee to correct himself and which were not followed by employee, due to which the Mgmt has no other alternative but to resort to this extreme step. However, the Mgmt should be prepared to conduct enquiry into the incidences leading to loss of confidence in the Court.

I totally agree with Mr. Dinesh,
There cannot be a standard draft of loss of confidance letter. It would be situation specific and depends upon a lot of things. Please specify the incident to enable us to jugde the situation in a better way.

I agree with the responses of my learned co-professionals. There is no standard format for Loss of Confidence. The reasons can be many. Unless you are specific, giving us the complete case history, it will be next to impossible to give you a solution.
Next to Doctors and Lawyers, we too require the complete case history to provide you proper advice !

Dear All:
It's entirely impossible to have a model letter for the scenario you are put up with. Losing confidence is normally with 'faults and fissures' at both ends - which if often a bitter pill for management to digest. What must be realized that as professionals we are first partners all - having such an air permeate at all levels in the corporate hierarchy gets the 'pulls and pushes' to start moving in the right direction -- then writing the text is more a matter of language, than of issue(s) at stake. However, you HAVEN'T mentioned an iota of any additional information/inputs in response to some of the members' queries.
MAYBE this defeats the very larger purpose of this Forum--that of knowledge-sharing between ALL the members thru resolving issues by discussion & evaluation of suggestions by the FEW participating members?
It's upto you to take the call I guess--especially given that you are not a new member.
