Good Evening
Sir I have one query regarding leave.We are providing 35 leaves / yr (Per Calender year).7 CL, 7 SL & 21 PL.If one employee take 7 Leave in January 2013,he or she would be deducted from monthly credit or yeraly credit which compnay is providing.If on monthly basis then he would be entitle for LWP for excess Leave than his/he monthly credit
Candidate is working since long time.

It depends completely on your policy, and more so the culture and belief of the company.
How did it work before?
Like in my firm, we have similar leaves for the year which makes 1 leave in 20 days accumulated through the year. At the end of the year - SL and CL lapses, PL is encashed and hence lapsed.
We have allowed SL though, one cant prevent someone taking leaves on genuine reason. A person took SL as she underwent a surgery, produced the medical certificate and bills, so that was paid leave. Sure the paid leaves entitled to her is reduced by 4 instead of the allowed pro-rata basis... And we did not deduct the salary
For CL and PL/EL, for my company it depends on a case-to-case basis.
However in usual scenes, in bigger firms, leaves are pro-rata base and so if you take more than granted leaves per month, that becomes your leave without pay...
But as i said before, it differs from company to company and policy to policy. Why don't you take advice from your senior on this?

Dear Mr. T.GOPINATHASARMA
Leaves: Every employee who has served with 240 days or more during a continuous period of 12 months in any establishment shall be entitled during the subsequent period of twelve months , to leave with wages may be accumulated upto a maximum period of sixty days
Sick leaves : 12 days
Casual Leaves: 12days
Encashment of leaves: Every employee in any shop or establishment shall be entitled for encashment of leave with wages for a period of 8 days in a year
