Hi,

I have been working with a company for the last 5 years and i have been the best and consistent performer all through my tenure in that company. Recently i have availed my maternity leave for 6 months which was approved by the company. On my date of reporting back to work i am informed to take 3 more months leave as they do not any requirement for me in the company. I was rated highest rating in 2012 appraisal and i am the most tenured employee in the whole HR team. They even hired an employee in the month of march 2012. On my date of reporting i have informed my manager that i can work for 9 hrs (i.e. from 8.00 am to 5.00 pm) and i will not be able to stretch beyond that in office but can work from home if required as i have to pick up my baby from the daycare. In my current company there is no work from home option. Now my question is how can my current employer force me to take leave which i am not interested to take just because i cant stretch my working hours after being the most tenured and best performer all through. Now i am on extended leave with LOP. I am also been informed that my employment may be continued or discontinued after 3 months based on the requirement at that point of time. I feel its very unfair for them to do this to me at this point of time after being the most faithful and reliable employee at all hard times all through my tenure. I am anyways looking out for a job change but it will be difficult for me to work in a new company at this phase of my life as the expectations will be high in the new environment. One more thing is my current employer did not even give me my promotion even after being the top performer as my employment is not confirmed. They are telling that they will promote me for sure in next appraisal(i.e. 2013, July) if my employment continues which they are not sure. Should i just keep quite and look for a job and start all over again? I feel its very wrong from their side to opt for a non performer than a good performer who has to concentrate on her family along with office work at this point of time. I feel like doing something which makes them realize that they cannot do this and get away with it. Please suggest.

Sorry about the situation. However need few clarity on your employment status. Would appreciate if you could help me out with that.
What is your designation in the company ?
Your team size and company size ?
What type of industry are you employed with ?
Do you report to any one in the department or to the Executive team ?
If you are/were heading the department, then why did you plan 6 months leave, rather than extending that after 3 months, based on your health conditions ?
You have mentioned that they hired someone, do you think he/she is your replacement ?

HR team size: 10(including recruitment team of 3 members) and company size- approx 900 employees

Employed with company which provides services for IT, KPO and BPO. I am HR business partner for 300 IT employees.

I report to Head HR

Initially i planned for 3 months and on completion extended it for 3 more months as i am the only one who has to take care of my baby and there were not much daycare's who will take care of infants. Current day care that my baby is being sent to did not have infant care earlier, based on my serious request they have setup the infant daycare facility. I have joined her in daycare thinking tat i have to return back to work on 9th Oct 2012, but after joining her by paying non refundable deposit my current employer informs me to take extended leave on my date of return to work. Now i cannot even stop my baby going to daycare because with great difficulty she got adjusted and i have to anyways work in future.

They hired the new employee as there was a requirement and he was not my replacement initially(tats wat i am assuming) but he took over my work once my maternity leave started and that was on 10th April 2012.

Dear Kalpana,
I second to Mr. Sid. Even my Mentor & Coach Mr. Dinesh Divekar repeatedly says, "INDIA WILL NEVER CHANGE", employees will have some or the others issues with their employers and it will continue for ever. Two of my ex-employers didn't recognize my talent, even though i did my best for them, hence i decided to leave them for good.
If you are truly talented, you will get a better job. to maintain POSITIVE MENTAL ATTITUDE, please keep THINKING POSITIVE all the time else your NEGATIVE THOUGHTS will kill or erase POSITIVE THOUGHTS. My good wishes are with you.

I believe India will improve - it'll just take 4-5 generations before we see that people are valued by others. The issue is caring about other people makes you vulnerable and open to a hoard of problems that can be piled on you. The percentage of people who are causing problems, not working properly and adding to the whole mesh of substandard quality of life is much higher than the percentage of people who actually care about others and work hard. This invariably adds too many problems, if you care about the problems of others - its overwhelming for most and most find it easier to be numb about it.
So, worrying about your employer being nasty to you is not going to get you anywhere - best to ride it out and do whatever work you find very well and keep growing. And try to find employers who seek loyalty to a cause and not to the organisation or self.

Thank you all for your valuable time and advice. Just wanted to clear one thing that I have definitely moved on in my career. There is no point of working in a company where your work is not valued. Its the company that ditched me but the knowledge and the contacts that i have gained are there with me helping me to reach heights. All the people i worked with or reported to are trying their best to place me in a company where i don't have to face such kind of situation again. Having so many senior members support i have no doubt that i will not get a better job.

My whole point was that my current employer should know that what they have done is not right. Anyways by doing this they are hitting their own reputation. All the employees whom i have retained and the female employees in the org will definitely not like when they come to know what has happened and they will definitely know what has happened some or the other day no matter how much the management tries to suppress.

There is no fun in life with out challenges in it. After all this is a very small issue when compared to other issues we face in life. I am not in a hurry to join any company which has no moral values. I will take my time to find the right company. Once again thank you all. :-)
