hello everyone, i need help !
i had joined a mnc (bpo) couple of months back and becoz of medical reasons needed to leave the company without serving notice period. i left the company on 20th and as per the payroll i got my salary. i had informed the company that its very unlikely that i would join back despite that they kept calling me. i recieved my next month salary as well. becoz of health issues i couldn go to the company. they sent me termination letter and now after 2months they have sent me recovery letter for 22,000/- which is a huge amount and i cant pay them. is there any way out. can they take legal action against me? im very nervous dont know what to do. please need advice urgently.

The company specifies in appointment letter very clearly regarding the action carried while the employee fails to serve notice period. Ex: "Termination of services may be effected by either side tendering two month’s notice or payment of two month’s basic salary (as per management discretion) in lieu of notice after confirmation" .In such case, the company has every right to claim the amount back.

yes i do understand that its mentioned in the appointment letter but i hardly worked there for one and half month.. was still in training period... and now after 5months of leaving i have got this recovery letter from company. i am in no position to pay this amount ! would they be able to take any legal action against me??? please advice what should i do

If you signed the appointment letter copy or contract agreement with them, then definitely they can take legal action. It is better if you meet them directly, explain your situation clearly, try to convince them and solve the problem smoothly instead of getting frightened. This may definitely help you.

in the appointment letter its mentioned as you also said mr srishreesree that i need to serve notice period of 1month after confirmation... that after probation 6months
but i worked there for less than 2months...nothing in the appointment letter is mentioned before probation period???
so how can they ask for money when i was not even confirmed by the company

Dear Member,
Irrespective of whether you are in probation or not, if you are paid for the days you have not worked for, you need to refund it back. As per my knowledge, terms regarding notice period during probation will also be specified in appointment letter. Go through it keenly. Normally, no company wants to loose its investment. An employer has definitely more power than you either legally or in any other ways. Hence, instead of going against your employer and putting your career under soup, it is better to solve the problem smoothly.
