I was forced to attend night shift despite of the fact that my manager knew that I was on medication.I informed him multiple times that I will not be able to attend office in night due to medical reasons and being the only female employee in a team of approx 50 guys. But he forced me, harassed me to attend night shift. he called me more than 10 times. When I raised this issue to his manager and HR head. He became quite for some time. Again he started forcing me to attend the shift that was 11-12 hr per days. When I told him its not feasible for me he started threatening me that he\'ll fire me if i don\'t take night or 12 hr shift. I finally resigned from my organisation. I was pressurized to give 1 yr commitment for it. I raised my concern to hr head but no action was taken from anywhere. I never received any call from hr team. It was not only me who was facing problem from his behavior. His whole team had problem with his behavior. Can i take any legal action against him

Dear Deepika,
You could have mentioned, what type of your industry is and what was your designation or the nature of work. How come your shift hours are 11-12 hours?
You want to take legal action now but do you have sufficient evidence? Have you recorded your discussion with your manager or HR Team? Do you have documentary evidence? By the way, is your industry exempted from working in the night by women staff? Just because you were told to attend night shift, how can you take legal action?
After raising your concern to HR Head, why you did not approach your MD? When your manager was threatening, why you did not approach higher authorities?
Before taking legal action, I recommend you approaching labour officer of your area. Let us see what he says. But you need to prove "harassment" properly to him with sufficient evidence.

Hi,

I am Engineer in Telecom Industry. I have worked in shift that includes morning evening and night for my organisation. I got internal mobility in my organisation itself. I was transferred from Noida to Bangalore. I never had issue for attending night shift till I got an injury due to which I was on strong medication.

I informed my manager about the reason why I am reluctant to attend night shift. I also informed him about the issues I was facing in the morning shift also as I was the only female employee in the team. I was not comfortable with the language and behavior of other members of my team.

He behaved rudely multiple times. I informed my general manager about it(his manager). though no action was taken. I told my general manager to move me under any other project but no action was taken. I got internal mobility in other project. I was not released by manager for it also. Though I was not in any project at that time. I have written mails for most of the issues.

When no action was taken and I put my resignation , my manager called me up and asked me to take release within 6 days. though my company policy says 1 month notice period. He called me and forced me to accept it. As per my organisation policy it should be mutual decision between employee and manager. Then I didn't find any other way out. I wrote mail to my organisation MD,VP, HR head of India. I still didn't get any response from them. My general manager called me and later after discussion he agreed for one month notice period.

I am not sure , what action should be taken from my end. But after serving my organisation for almost 2 yr I felt bad. because in my previous job role i was serving my organisation in 24*7 support. I was in my office in festivals like holi and diwali also. When i needed their help no one even answered my query.
