Hi,
I have to frame leave policy & a holiday calender for year 2012.
I need to know the Govt. law related to this.
I would like to know the minimum no. of leaves an organization needs to give to its employee.
I beleive there is no upper limit but would appriciate if anyone share the minimum no. as per Govt. law for giving CL, SL & EL.
Also what is the minimum no. of holidays are mandatory for an organization to give to its employee.
Appreciate your replies at the earliest.

Thanks for the reply.
The links you provided contains very old data. I would like to know the minimum no. of leaves as per current/latest Govt. Law.
You mentioned 7 CL & 7 SL. Can you please let me know is it what the latest govt. law says.
Mine is a pvt. ltd. company which deals in logistics.
Please revert.

Dear Vidhi,
Greetings for the day!
First you should know under which act your company comes i.e shop and establishment act Delhi or factories Act. Accordingly you can go ahead with leave and holiday.

Hi Trupti, If I am not wrong there is no Shop & Establishment Act in Delhi. Well I have checked our company neither falls under Shop & establishment act nor in Factories act. Regards Vidhi

Dear Vidhi,
There is a Shop and Establishment Act in Delhi.
There is No Law with regards to Holidays per say.
In addition to a weekly off, there are 3 National Holidays.Other than these, it is upto the employeer to give additional Holidays. There is no Min or Max for this--you can say Min is 3 as there are 3 National Holidays.
In case, you decide to follow guide lines of Delhi Shops and Establishments Act then you may opt for 15 days PL /EL in a year (5 days after every 3 months) and 12 days CL/SL in a year(1 day for every completed period of one month).

You mean in Delhi Shops and Establishments Act we have to give minimum 15 days PL /EL in a year (5 days after every 3 months) and 12 days CL/SL in a year(1 day for every completed period of one month).

what if a company isn't giving any SL/CL leaves ? Would that be fine ?
Is there any clause of minimum holidays? i mean can a company club holidays and paid leaves together ?
I have been observing many companies practicing such, they club holidays and PL and make its total as 21 and dont give any CL/SL...is that fine?
Kindly advice.

1 earned leave for every 20 days of working..... For CL & SL go through general practice followed by other same companies. Regards, Kalyani

Dear Vidhi,
According to my knowledge your company will come under Delhi Shops and establishment Act and the said rule mentioned by Mr. Suresh are correct and applicable. However if your management agrees you can increase the number of holidays accordingly.
