Hello Seniors,
Ours is a pvt ltd Co, it is incorporated in October ,2012, earlier it was a sole proprietorship firm. we get holidays on all Sundays in a year & on big festivals like Deepavali, Dassera ..etc. Except these days if any employee takes leave, his/her salary is deducted ( gross salary divided by no. of days in a month multiplied by no.of days leave taken).
Can any employee ask the management for atleast 12 casual leaves in a year?
What are the rules applicable with respect to leaves to pvt ltd companies?
In our company only to some senior staff 1 day leave is being given (10 employees, we are total 55) . I am also one of the senior employee but I am not enjoying this previlage.
I expect everyone should be treated alike. Please help me what should be done to convince management with this regard.

Dear Friend
If your company is falling under Factories Act, there is no provision to provide Casual leave to the employees in Factories Act. It allows only Earned leave. (based on last year working every 20 days one day leave). But in the Shop and establishment act allows Casual leave and sick leave. Please go through.
Allotting CL is the management decision only.

As far as leaves and holidays are concerned there is no difference between private or public firms.For holidays you refer Karnataka Shops & Commercial Est: Act and for holidays refer Karnataka Industrial Est:National and Festival Holidays Act.

Every employee of an organization is entitled to leaves (whether CL or Earned) and it is not on managements decision whether to give it or not. It is compulsory for them to give. There needs to be policies in place for leaves in organizations for the same.
