Dear All,
Suppose if an organisation has 5 days working (i.e. Saturday and Sunday Off) and if an employee apply for maternity leave and maternity benefit Act, in her 84 days maternity leave, can we include saturdays and sundays or these saturdays and sundays off will be over and above the prescribed maternity leaves?
Further, what about the holidays falling in between?

dear govind
as per law she is eligible to avail the maternity leave of six weeks before & six weeks after delivery, so it dosen't matter what is the working culture of the company i.e. whether 5days or 6 days. whatever holidays fall in between that period are not given special treatment. maternity leave will be considered as leave irrespective of how many holidays fall in that duration.

Hi Preeti and Kamesh,
Thanks a lot for your reply. However, I have a little doubt. As per the Shops and Establishment Act, there should be a weekly off. Considering this, during the entire period of 84 days, approx weekly off should be 12. Shouldn't be these 12 weekly off excluded from the maternity leave?
I think there used to be a decision where it was notified that the other leaves and holidays should be excluded from the maternity leave.
Can you please guide me further?

Dear Govind Maternity leave (84 days) is inclusive of weekly offs & other holidays. Dear Kavya Maternity leave (12 weeks) is paid one employees gross salary is covered in that. Rgds JC

Dear Goving.
It is a general rule in all organisation that when an employee is proceeding on long leave that may be earn leave, sick leave or maternity leave, all holidays falling in between the long leave will not be excluded for the purpose of number of days.

dear goving,
dosen't matter of holidays weekly offs. include holidays, week ends after dilvery 84 days in mandatory in pravite sector. not govt sector. in govt sector 120 days provide leves.
which is 100% insured of maternity benifit act getting any employee.
