ESI is covered in all states except in the states of Nagaland, Manipur, Tripura, Sikkim, Arunachal Pradesh and Mizoram.
And also the employee who is earning less than Rs. 40/- is exempted from contributing his share for ESI

I work in an Chennai based infrastructure company as HR Executive in 'jammu.
Our salaries after deducting PF comes from Chennai office. We have heard that J&K has different rules for EPF and
ESI. if we have to give wages to local labour,wat should we do for their EPF and ESI.Our work in Jammu is for 2 years contract only.So can you suggest is there is need for us and labour to open these accounts separately or not.if yes,what to do now?

ESI is complete code and covered much area of India, but so far medical facilities are concern it is difficult to provide the same in many areas and so, the corporation has made areas in two parts namely IMPLEMENTED AND NON-IMPLEMENTED AREAS.
Factories and Establishments situated in implemented areas are covered and on the contrary; Factories and Establishments situated in non-implemented areas are not covered, so, u have to obtain the list of areas from corporation only.

I think, these states are out of municipal limits and very far away from ESI covered region, that's why, these states are not applicable for ESI. The employer must have to provide WC policy to their employees.
