Our company takes this bond when employees were sent to onsite in deputation. This bond is taken in 100Rs Stamp paper where employees are asked to sign in pages. One of the clauses in the bond says
"While working on the assignment and for a period of three years after the completion of the assignment, I shall not take any employment of do any business with the customer without a written permission from the company. If the customer tries to solicit business directly with me r gives me an offer of employment, I shall inform the company immediately of the same"
Now my questions are
1. First is this bond undertaking is legally tried ?
2. One of our employee came back to India completing his assignment to our customer and resigned immediately. We now know that he has got an offer from the same customer. So citing the above clause can my company sue the ex-employee and ask for compensation ?

I don't think that the bond will be maintainable, whereas if the bond was for recovery of training cost incurred by the company by sending the employee abroad and training him there, to the extent of such training cost, the company could claim compensation.
