1) One of my friend working with a MNC ( hitech industry) has been asked to resign.
2)Failure in doing so, his immediate superior threatened to " Terminate" his services. ( immediate superior refused to state the same in writing )
3) As a pressurisation tactic they even hold his salary for some time.
4) Later on they credited salary but his online payslip shows the malicious value/ figure.
5) As per my friend they don't have any basis to terminate him & contract asks for 3 months notice, which they are refusing to respect.
6) Still he has not got the payslip.
Due to recession the job market scenario is also not encouraging.
Please guide what he should do? Can an organisation forcefully ask employee to resign because they don't have any basis for termination?

Immediately take shelter with the Assistant or the Dy. Commissioner of labour of your zone, lodge a complaint against the present employer and let them be briefed about the harassment and threatening given to your friend, there after file a case in the labour court. you will get complete justice and you will get all of the back wages along with all of the statutory payments which are due from the employer till date of verdict given by the labour court, nothing to worry, we are after all living in a civilized society not in a forest my friend, we are completely safe under the law of natural justice and with law of the land.
Go ahead and fight and teach a lesson to such rode employers who are not less than mafias still alive in this country.

One of my friend working with a reputed company in India. He have joined this company two years back. He has been a performer and getting good rating and bonuses. Now recent changes in company due to cost cutting ,employers are asking employees to resign.They told him that his position is redundant so he need to resign by giving personal reason .He denied giving personal reason but they forced him to resign as they said the order has come directly from MD and they cant do anything . They also said every body of his positions across PAN india have been communicated and process has begun. They have been telling him that he will continue getting 3 months salary month on month. so no need to worry. he can show the payslip to other company if he want.
Later he wrote resignation letter with conditions a) that his notice period will end after 3 months, and he would be paid full salary for this period, but they denied signing my resignation letter . Then he wrote email to hr his resignation letter with reason his position is redundant and company asked him to resign .he has forwarded this mail on email to HR and his supervisor.
After few days of resignation they are saying his notice period is 1 month and not 3 months . They are now saying that he would be getting basic pay of remaining two months .(In my terms of service its mentioned 3 month notice period )They also saying that one mail has come wherein they have changed it to 1 month notice period. Whatever but he is not aware of such changes .
Company has not shared any mail on this whole communication..
