Hi,
I have worked for a staffing firm for 4+ years as HR Resource - and had the chance to use my skills for various functions at different levels of management.
I had quit the firm on personal grounds last year. But the firm denies to issue any relieving letters / work experience letter , that too after serving the mandatory 1 month of notice period. Now whenever i approach them to settle down the dues, i get to hear one reply
"You left on your own - we cannot issue any documents thereof".
Kindly suggest any solution, as i am jittery about my future assignments.

simple. file a complaint in the labor commsioners office. then they themself will to you to clear your account.

Hi Balaji.
Is it possible? as i dont have any documents to prove except my Appointment letter at the time of joining and the Business card at the time of leaving.
The only mail evidence is my resignation email which i BCC to my personal id.

Hi Kiran,
As you said you have a resignation mail. do one thing whtever conversassion you are doing with them, do it through mail. so that you will have evidence about what they are saying. then that will play a major role in the case.
You can file a suite, as you have a appointment letter. as a proof of employeent with them. and as they must be issuing the salary to you with the salary slip (with proper stam and sign). Every company have the MIS of salary and live and left employees. so dont worry just GO ahead with the labour court.

Dear Mr. Harshal,
Thank you for the insight.. but let me admit that i was in a honey trap over there.
Internally none of the employees were issued any form of Salary Slips. They maintain the Salary MIS - but we used to sign on vouchers.[salary was issued in form of CAsh.]
In spite of being in system for long i could not change these basic things within the company.
i often felt that its too much murkier.. and things never settled down, even though the management made huge promises.

you must also b having your resignation letter stating that you are resigning and the notice period starts from .... to ........ thats enough for to fight out for your settlement

U must be having ur resignation acceptance signed by your manager.You can use this document as a proof. Trust it is gonna help you.

sorry to say but is true that most of the consultancies are exploiting it own’s employees . You having sufficent document to support your case, just put a case in labour commisionar

Dear Mr Kiran,
Please bear in mind that always filing cases with Labour Commissioner is very easy but getting justice as an individual is not easy. But, due to this
you not only lose your chances of getting experience certificate and instead your grievance airing tendency thro' courts/labour commissioner will be before you wherever u attend the interview.
Based on my two decade long experience, I infer that most people who
are reporting problems with their employer in this site are not speaking the
other half of the circumstances they have created on their own with their employers.
Everybody is a human being and with the exception to the few, nobody
will create problems finally for the leaving employees and instead they would help.
Hence, please be sure to show restrain seeking legal remedies as it would definitely a black mark.
If you are true, definitely most employers would accept your experience if you show your appointment order.
