hi, The company cannot hold the F&F. few questions i would like to ask would be do you have a copy of accepted resignation letter or any document which proves that you have been the employee of that company during the tenure you have mentioned? if yes, You need to send a civil notification to the company stating the requisites i.e. F&F failing which you would go to the court. Also if they hold your salary for more than the stipulated period they are also bound to make a payment of interest so accrued.

Dear Sir, Yes he has Appointment letter,All salary slip,Resignation and acceptance letter,bank transfer statement and all legal document. but in acceptance letter they mentioned :- His account will be setteled only when all the files,document submmited to the undersigned, ,complete all the work related to his responsibility) and they have submmited all the file to concern department. hi Jyoti, In such case have they signed anything pertaining to F&F with the company stating no dues pending.if so it would be difficult for them to prove that anything is pending. If not ask the company to write a mail stating the kind of documents and files required on a mail where you have demanded a F&F. regards, Sandeep

Dear Sandeeppinto, on this ground if employee could not finish the task in notice period then, is employer is authorized to not setteled his account? and i think employer can't bond any employee (Manager) to give these type of responsibility in notice period only he can take files and documents. is it true or not? Dear Jyoti, Settlement of accounts of an employee cannot be withheld, except where he has been convicted with misconduct. If 'misconduct' is not the case with the person in question, then it will be wise to settle his F&F instead of waiting for him to initiate legal proceedings against the compnay. Let your management understand that it is not worth wasting time into legalities when that time can be utilised for business development. Good luck. Prashant

Dear Prasant, Thanks for your reply. Now please tell me what is legal procedure for his settelment because they are not ready to give his full and final amount and they are forcing him to finish all work then they will release his f n f amount. Regards Jyoti
