Hi seniors,
Need your valuable suggestion,
It’s been eight months running working with the organisation and still I have not received my offer letter/appoint letter from the company. I am asking for these basic documents but no response from the management people.
I am not the single person who is suffering with this problem; my other colleagues are also suffering. My company is into software development and out sourcing. I heard that software people have all these documents (offer letter/appointment letter). So what should I do????

Dear Mamta Jena,
It seems that there is no responsible person in your organization for all these that’s why they are not bother about all these basic things. Go to your immediate (reporting boss) and ask about the basic document if he avoids then ask him who is responsible for it. If no one is responsible till now then ask him to implement because you are HR. Take the responsibility as a pioneer.

Thanks alot for your quick response pankaj. I asked so many times to my immediate boss as well as we had a discussion with our MD but he is just saying i will give u those documents b'for u leave.

Please do have a copy of the offered e-mail conversation if you have any! and If your in to hr, then prepare the documents take to your immediate supervisor to get the approval!

Please get me right if I am wrong. Is your Boss saying that he will give you your offer letter/ appointment letter before you leave??? Is he nuts!!!! I think you are either too young or relatively new to this field. Don't get me wrong Mamta, but Is this your first job. if yes, then I can understand your dilemma, but if not, then I think you should not have taken the job without an offer letter in the first place. Since you are saying that many others are facing the same problem, I have a gut feeling that you people are not under the direct company rolls and it may be quite possible that you all are handled by outside agents, which you are unaware of. Don't waste your time in such companies. Find yourself something better and look ahead.

I understand your situation. But could you please provide more clarification? Are you working in teh HR department or working as a software professional with that company.
Case 1: If you are the HR there -
Please prepare a sample appointment letter / offer letter and take a print out, also prepare additional policies to accompany those print outs with (employment policies), and show them to your Management. Say them that as an HR you would like to implement them. If they are negative about it, kindly say that as per the law, there requires to be such documents atleast for sake of audit. Else, the company may suffer in future.
If they are worried about the employees using the same for a better job, let them know that you would also take care of retention and avoid possibilities of people leaveing. Atleast the future joinees can get their ofrer letter / appointment.
If they say that they will give you the offer/sppointment only when you leave, smile and let them know that your chances of leaving in near future is less (get their confidence)
Case 2: If you are a software professional there:
Ask the HR :-) :-D
Else, if there are no options like the above - just mention that you will need a certificate stating that you are working here since (so and so date) so that you can submit the same for approval of loan. Atleast you will get a document stating that you are working there!
Such owner driven companies - are difficult to convince. If there is an HR - no problem, the first suggestion can be opted, else you need to think of an innovative way of somehow getting the proof. That is you need to think of a way that the company has to somehow give you the docs and there is no other go. . . :!:

To avoid this payment of gratuity and PF contribution to your account from the date of your joining its easy for employer to deny you this previleages if you don't have documentary proof to claim such gratuity and PF contributions from your employer.
This is oversmartness on the part of your employer to deprive you from these legal obligation he is binding to law.
You cannot prove your claim until you have documentary proof of employment from particular date to claim gratuity and PF contributions if your employer is manipulating your PF account by not adding your name to PF account or deduction from your salary etc are easy in such cases.
Employer's intention is malafied and you must take this issue seriously.
