Dear Frndz,

I am Jeevarathnam working for a small software company where the strength is 28. Yeaterday labour inspector visited & asked for some records.

They are.

1) Attendance with prescribed format (Muster Roll) where in the employee has to sign physically everyday. Is it applicabe to software company & are all the companies practicing the same.

2) In payslip we are not showing the DA & he is insticting for the same. But I dint find in any company payslips. Is it necessary & he is telling as employer & employee has to sign on the payslips. (Is it mandatory. if so then are the big companies getting signatures from the employees. Then what about the computer generated payslips)

IF DA is compulsary what is the ratio of DA & is it on Basic or Gross salary.

3) He is telling as the appoiintment orders should be given in the format of preprinted format which is readily available.

4) Is gratuity record has to be maintained even if the company is 2 years old.

5) He is asking for annual returns in form U. what is that & what all has to be shown in that.

whatever inspector is asking is correct .he can not ask things in writing which are illegal but software company does not follow the law of land.they are required to follow all laws as other establishment is following.
muster roll to be maintained as as per karnatka shop and establisment act.
pay slip to be signed by both employer as well as employee and u should have prood of it.
it is not necessary to show DA seprately but you can club DA and basic and can show them in basic.
dear you can not make any record comutoriesd even salary register.if u want to make comutorised than all formats to be approved by labour commissioner and u should take permission for same.

Dear Jeevarathnam P,
The labour law enforcing agency including labour inspector can ask you to produce the relevant records. According to yours statement he have only ask the statutory relevant records only under State Shop Act, The Minimum wages Act,1948 & The Payment Of gratuity Act,1972. Plz go through these enactments & the respective State Rules you will find all answers of your quries without fail.

Dear Mr. Malik.
I argued with Inspector regarding tha Basic & DA are are clubbed and showed as basic. But he is not accepting for the same. He is very much particularly telling as it has to be seperated. What to do for that. any Idea as what in the minimum wages in basic & DA for IT industry for the year 2009 & 2010. I asked him abt the same but he is refusing to give information.

Dear Friends,
I am working in a public ltd co. One day labour inspector visited at our office and asked all register and we have produced. We are not in a position to produce the Form-R,Form-P & Form T which are maintaining manually is not possible. Pl let me know is there any software available for which can be upload from our data.
