Seniors pl help me.
We are into retail business and presently covered under ESI Act.
Many of our employees have been requesting us to remove ESI
and give them some mediclaim insurance policy which is more useful
Is there any way out to get exemption from ESI coverage .
If so, please guide us. We are prepared to appoint full time doctor to take care of our employees with good mediclaim insurance policies covering all the employees .

Dear Murthy,
Coverage of an employee under ESI depends upon his salary. If monthly salary is less then Rs.10,000/- then employee will be under ESI, and it is in the benefits of the employee.
Once the employee cross the 10,000 mark, he will be removed from the ESI and he can be registered for some mediclaim policy. There is also group insurabnce scheme available for employees whose salary is between Rs.10,000 PM to Rs.15000 PM

as per employees insurance act 1948 section 87 exemption can be givenby notification
through state government and this exemption can not be given for more than one year,ofcourse getting exemption is impossible.
now i would like to ask one question the benefits you will be giving can not be more beneficial than ESI,say for example
1.what is your plan for the treatment of dependants like mother ,father ,wife and children of employees.under ESI these benefits are given.
2.you will take a medical insurance ie medical insurance for certain amount ,there is no limit in ESI for any treatment.
3.if there is fatal accident and employee got disablity permanently than they are entitle for pension through ESI,what is your plan for that?
4.if employees dies during course of employment thanhis dependants get lot of benfits from ESI ,what is your plan in this regard?
so i feel one can not formulate better policy than ESI.

Dear Mr. Dakshina Murthy,
I wd suggest continue with ESI. If employees who are covered under ESI are having a negative opinion on ESI, pl try to correct the same. As employees covered under ESI must be drawing less than 10000/- gross, they may r looking at this as a liability but pl educate them.
Pl also consider what kind of benefits and to what extent your mediclaim can cover.
Pl go through ESIC for further info on ESI.

Dear Murthy,
Without informing these things to ESI officials please organize a workshop which through them(ESI officials). That will make all to understand the benefits, it gives employees good benefits.

Dear Murthy,
ESI is central Act, not policies.its complesary applicable and eligible. than if any employee salary more than 10,000/- (i.e. 10,001/-)has been exempted than u give other policies like W.C., Personal Accident, Medi.clame etc..... but i advise to be must W.C.policy under the W.C.Act. 1948. as per legal ( Only exempted employee).
