Please guide me on the issue for leave calculations for contractor empployee . We have out source contract employees and provision for leave encashment policy for them. I had query for this ,generaly leave calculated as 1 leave for every present 20days(i.e. 1.5 for month). Like this is it calculated for 12 months period as 18 leave or any else calculations is their? please give guideline for the same.

please raise your query with seprate heading so you can get proper answer.
as the question was raised for leave calculation it is one leave for twenty days working in factories however under shop and est act rules are different.
in factories it comes to maximum 15 days in a year.

As per shops & Establishment Act (Mumbai), the establishment should provide for CL-6, Sick Leave-6 and PL/EL 15 days to their employees in one year.
Not sure whether it varies from state to state. You may check with your state.

Minimum working days in a calander year is 240. take a count that when he is present are signed in the register means physically he should work, ESI accidient leave can be considered. if he is not crossing 240 days in a year thenhe is not eligible for the Earned Leave. This is for a Factory. being I donot know about your organisation if it comes under S & E please check the local act. for S & E also we can consider this Calculation.

Every worker who has worked for a period of 240 days or more in a factory during a calendar year shall be allowed during the subsequent calendar year, leave with wages for a number of days calculated at the rate of-
A) If an adult, one day for every twenty days of work performed by him during the previous calendar year.
B) If a child, one day for every fifteen days of work performed by him during the previous calendar year.

For pl calculation for under factories act, 1948
if in previous calender year, if 240 days working (this will include all sl,cl,pl, weekly offs, esic leave,holidays) then the employee is eligible for pl.
then for every 20 days 1 pl.

while giving querry pl mention type of establishment such as covered under Factory Act or Shops and establishment act.
Normally if your estblishment is covered under FA in this case provision of FA is applicable to contractor workers also.For thias purpose pl refer the provision of Leave with wages.
for compution of 240 days actual presence+accident leave+maternity leave+ is required to be considered. Lay off provision will not be attaracted to cont employees.Pl refer State rules of Factory Act also.
