Respected Seniors,

I work with a reputed Financial company, a company known for being a employee-oriented and its code and culture. I am a HR professional with this company for more than a year now.

I'd some altercations with my Reporting Manager in the past for which I verbally apologised as I know" Boss is always Right". I was threatened for spoiling appraisal at times and was told that I could be given a memo and terminated for this. I kept quiet that time and took all the rubbish.

Reporting Manager has convinced all Sr. Mgmt people about my performance is not upto mark and my behaviour is rude which is not true at all.

Now I am asked to leave the company. I am asked to put down papers, a resignation letter with a back-dated effect. I was shocked when I heard this. I dont have a job in hand and am totally upset.

I had a word with few of my good friends,mentors and they replied to resign and move on and if I have time and energy, I should fight it back.

Please guide me what to do in this situation as I am facing this sad situation in life for the first time.

Dear snehlata,
I would rather suggest you to leave that company and search for a better oppurtunity, if you realy have the talent wid you then u wil get a job of your kind.
Don't take the shit everyday, we HR guys some times have to be aggressive, you cant really stay at a place wer people dont like you and where you wont get worth for your work.
Istead of wastin your valuable time on fighting with the management you can rather spend the same time to buy a job for yourself.

Dear Kiran,
Thanks for the suggestion.
You know all the days I have kept quiet and taken all the rubbish. Now even if I leave without saying a word, people (my colleagues and team members) would think that I was at fault. R.M will prove that I was asked to resign instead of getting terminated.
I have worked with dignity and respect and never in my dreams thought of such unfortunate situation. I have never committed fraud or crime and I always wanted to resign when I wanted to, as per my own decision.
Even if I walk out without uttering a word, I will have a guilt feeling of keeping quiet.
Please suggest.

Dear Snehlata,
Its really pathetic to work under this kind of work arena. You should definitely forward your resignation letter but in your own terms and circumstances generated.
You should mention the ground of resignation as the environment and kind of unprofessionalism cropped up in the department as specific.
--and draft the letter on the current date not on back date..here you can ask for the notice period from the company( if the employer wishes to terminate then also some prior notice or salary in lieu should be given off)
-- ask 4 the time period in which u can search for other employment.
-- and attach a grievance letter from your side too which should address your sufferings and favoritism employed in the company

Dear Poonam,
Thanks a tonne, for your suggestion. Attaching a greivance letter and asking for time-period is not going to help as R.M is hard-pressed to take personal revenge and hence asked for a back-dated resignation. I was even told that my notice period will be waived-off by Head HR, which was again a horror to me.
I know that this is not a right time to search/hunt for a job where most of the companies are getting into lay-offs.
I am going through a mental agony and pressure these days and there is no-one whom I can trust and have faith on.
Please advise as this is a SOS situation.

Dear Snehalata,
In our case, the management needs to follow the process of disciplinary action and should have asked holded a Domestic Enquiry to follow the principle of natural justice.
In your case you may use YOUR FUNDAMENTAL RIGHTS and approach the top most personnel in the management by providing a "SHOW CAUSE NOTICE" to them for your case and address your greivance as "Harassment".

You are already fighting a lost battle….choices with u are very limited…Its always wise not to fight with your boss when u know u can never win as he can spoil your career with the powers vested him by the company..even I am a victim of the same…hence I immediately made a make-shift arrangement for myself and left the company… as of now I am not working in HR but as an EA and trying hard pressed to get back into HR ..my suggestion would be pls safeguard yourself first ..buy sometime for the notice period ask them you are interested to serve the notice period rather than leaving and this would help you to find a suitable opportunity for yourself and move on...Its said that if you want to live in the jungle never maintain enmity with the Lion or If you are in the sea always befriend the crocodile ..

First Understand That You Have No Recourse At This Stage. If You Committed Any Argument Which You Feel Sorry For Accept Your Guilt And If Management Express This Is Retaliation Of That Event Then Challenge It Saying Issue In Writing The Ground For Termination And Take Legal Action.
Because If Not Even Then You Are Going To Be Victmised And If You Quitely Accept Then Also You Will Be Victmised. But To Teach Lesson That Its Not Easy That Anyone Can Harm Employee And Do Injustice Shall Be Challenged In Principle.
This Is Issue Of Principle..although Its Not Good For Your Image Becasue Market Do Not Appreciate Hr To Confront With Ex-organization. But Who Cares Once You Are Out Of Business Means New Search Of Job And At Least They Will Shut Their Mouth Forever In Your Case.........because They Will Know That Its Expensive To Open Mouth And Spit On Employee......
