i am suresh kumar, Accountant in Pvt ltd construction company and we are paying service tax since 10.09.2004 for commercial purpose buildings.

Now i have a doubt in this area. We are doing the multi-purpose building that means its includes the commercial purpose buildings and Labour & Staff Quarters( Residenceial buildings). It is not known that the approval and assessment received from the local tax authority (Local Village Panchayath) for the project.
In this case the service tax may paid to total contract bill value or excluding the value of quarters buildings. Anybody help me.

Im Linnan, from kochi in Construction industry, I had read ur query regarding the service tax.
kumar had to read the agreement executing to your clients! thats the main fact. Pls read the foillowing
1. if your company is a contracting company ie. building commercial complex to company & individual, if the agreement says the same you are taxable.
in case your came is selling the property at the finalised stage, means an outright sale, you are out of service tax, here only VAT is only applicable. here property is selling like a product. here risk is high, means that you are stricly collect the whole amount at the time of registration. if not the customer fails to pay, u have no choice other than!!!!.
out of the above conditions you are liable for service tax.
