I want to break the bond of my company which i have joined in july-2007 as a freaher.I have 2 years bond for 2 lakhs.I have signed one stamp paper with signature of 2 gurantators in letter of undertakeing that my guarentators will pay 2 lakhs if i terminate service before completion of bond period.But due to some unavoidable situation in march -2008 i have asked my company to transfer me to another place where my wife is working because her company dont have any office at my place and she also has bond in her company.even after 4 months they are not giving me transfer and telling me that "we can not give you commitment for transfer and if you are not satisfied with my answer you can find another way".So i have given interview in other company where i got selected with higer package but that company is asking for relieving latter of current company even if i told them every thing about bond and amount at the time of interview.Please guide me how i can ask my currently working company to give me relieving latter without giving bond amount to them...If i produce any fake letter to new joining company will it create any problem????:?::?:

Hi,
What I would suggest you is to talk with your new company and tell them that instead of giving them the releiving letter, you can give them a read receipt copy of your resignation email. Further in order to protect them from any future problems, you can give them an option of signing an affidavit which would state that you will be solely responsible for any financial liability if your previous company files any civil case against you in future.
Hope they will agree to your proposal.

Hi,
Just for your information in India there is no concept of a "bonded labor"!
In my previous organization we had the same "bond" system. However there were many people who left the place before the bond period and the organization could not do anything about it as Indian Law does not entertain "Bonded labor" concept!
If the organization is not giving you the relieving letter then I suggest you take a printout of your resignation email that you had sent to your superiors and show it as proof rather than making a fake one.

Dear Sir,

I need your help regarding the Bond Issue with me. Myself a Mechanical Engineer, had Joined a ABC company which takes a contract from XYZ company. My offer letter does not cover any bond concept. but when i joined the company they had signed me the bond that was one sided i.e in breach of bond before 2 years, you have to pay 50000 Rs to the company on a 50 RS stamp paper. if i had not signed the bond they would not give me the salary.

Now after joining, i got to know that they are also deducting the money for the Leaves i.e 15 leaves yearly and gives back the money after year. also there are no leaves like SL, PL etc. if we take leaves our money would be deducted from our salary.

They are not giving the salary slip. Also the girls and boys timings are different i,e boys had to work 9:30 to 7:30 while girls had to work from 9:30 to 6:30. Our job role is very risk as it is for Oil & gas Field. The company is not providing insurance also. they are covering us in WC policy. what is the benefits if WC policy if we died in the field.

so in this scenario, is it valid to breach the bond. i had completed 4 months and i want to leave the company due to this sort of harassment.
