Ministry is not governed by the Payment of Gratuity Act. Therefore, the liability is on the contractor only. Since you have not worked continuously for 5 years, your chances of getting gratuity from the contractor is also very remote. There are court verdicts allowing gratuity to an employee with service of 4 years and 240 days in the fifth year, yet these are all interpretations of law. You can also apply for gratuity through the Labour Officer.

With whom you had worked for around 5 years will pay it. If there has been real changes in employment, you cannot claim it also. Madhu.T.K

Hello Contractemployees,
Madhu TK has already clarified the Gratuity part earlier itself.
Pl note that your view of more than 5 years AS a Contract employee is NOT the criterion.
The criterion is what Madhu mentioned--you have to be the employee of ONE/SINGLE....repeat ONE/SINGLE.....Employer.
Since in your case, your Employer changed midway, you wouldn't be eligible for any Gratuity--however painful it may be.
Suggest look for another job ASAP so that you don't get into any depression due to this situation.
