EPS pension can be availed irrespective of the nature of death, only two conditions are:1. at least a month of contribution should have been made to EPS & he should have been on employment on the day of death, should be on the pay roll not necessarily working on that day.

(a) Dear member, it will be more better if you indicate whether (a) the employer has filed Accident Report with the concerned Branch Office of ESIC, (b) whether any FIR has been lodged with the concerned police authorities (b) If FIR lodged what are the findings of the police authorities, (c) whether Post Mortom was conducted by the hospital authorities (d) on filing accident report, whether ESIC authorities have conducted any investigation in the matter.
(b) Hope, as employer or an officer of the employer you will also discuss the issue with the concerned Branch Office Manager of ESIC to which your said employee was attached.
