I am also suffering with the same but problem is I am in United Arab Emirates where its not that easy to quit from a Job, you are quite lucky and i will definitely suggest you to resign from such unprofessional organization.

Dear Gauri,
You have been correctly advised by some colleagues through their post that you should put everything in writing spelling out your specific grievances and your inability to continue in the employment of the Company. Since there is no written contract in existence, you are not bound to give any notice to the Co. Ask the to pay your due salary and any other dues and leave ASAP.
There's no reason for you to stay on a moment longer (even if it is at the risk of not receving any dues!!!)

Hi Gauri !!!

In my opinion, it is absolute chance to you that you can convert present scenario in to success, how? ....please follow the guide lines...

Type your letter showing your acceptance as a Full time/part time (as the case maybe applicable) consultant for the company (not as an employee) where you are presently working. Mention all terms and conditions favoring to you (like if part time ... I will visit to your company once in week etc). Submit your monthly bill to the company and treat your company as your client.

By this what you will achieve....

1. You can start your practice by accommodating your present employment as client.

2. You can engage n number of other client.

3. You will be well known CS practitioner in your field.

4. Your Income shall be continued

Now ... you are thinking that Is consultancy letter (voluntarily made/prepared by you) whether acceptable to your company, please do not worry . ....certainly they will accept ( talk to them fearlessly/smartly & pursue them by showing them to keep you as consultant is much cheaper than to keep as an employee.

Draft your appointment letter yourself as retainer/adviser/consultat and said draft give it to your Director for approval, once he approve the draft take his signature on said engagement letter (letter head of company) & start practice.

Go ahead don't worry!!

Please write an official mail to your MD and mark to your consultant. As per my understanding from your mail, I think you are not a payroll employee of the Company. The Company must have hired you as outsourced employee since it happened to me when I started my career and I was not getting any official letter from the company. Then I drafted an official mail to HR an d CFO of the company stating all my issues. I even drafted that I regret but I cannot continued the job then immediately I got a called from the HR and consoled me. The very next day, I received all the official letters from the company.
Kindly take the right decision. I can feel your situation as I had also undergone the same.
All the best....Dont worry, no employer wanted to loose the good employee as it is very tough to get the right person.

You are wasting your valuable time in this Org. When you don't have any appointment letter or any letter of intent , their is no question of resignation letter. I think the organisation is treating you as a fresher & when they don't kept any record of you so the question of resignation letter is unnecessary.

my suggestion is you need not resign immediately. you first search better job for you, while attending interview you will explain real situation, interviewer will understand this kind of situation.

  • I do not quite agree with the suggestions of most of the members who have suggested to you that you are wasting your time and should resign immediately.
  • I would suggest you to resign only in case you have other job ready in your hand. Why waste time and precious income ? Get good job elsewhere and then resign. What is a hurry ?
  • You are not wasting your time. You are definitely getting some practical experience.
  • It seems you are working in a small company which is not having HR Dept. HR Systems and Processes in place. You yourself can set them. Make your own appointment letter. Take help of your friends to draft it. You can get samples / drafts on citehr itself. make a letter and get it signed by your MD. Matter is solved.
  • You are qualified CS. Are you designated as CS ? Are you registered as CS of company with ROC ? In case you resign, you will have to make sure to cancel your name as CS of the company with ROC.

Actually i had spoken the same verbally to the Consulant (CA)) but he was reluctant to accept. But now i think from your above discussion that i better submit the letter instead of only discussion.

Please advise Sir if instead of tendering my resignation if I submit a letter of acceptance as Consultant of the company (because appointment letter was not issued) then it means i no more an employee of the Company. whether ther acceptance of my letter is not required. Or is it like i am making my terms clear to the Company.

Further should i submit my letter to the Consultant of the Company whom i actually report or to the MD of the company, because anyways he is going to take the advise of the Consultant or ask me to inform him of the same.

Then Later i will have to submit draft of appointment letter as adviser/ retainer/consultant.

Now the question arises that can i submit now with immediate effect or shall i submit in next month.

Thanks Sir, The Company is ISO 9000 certification, with trade mark registered and also having full fledged HR dept but in different state. There is lack of co-ordiantion among executives.
