Good inputs. Thanks for all members. I want one clarification related to this discussion - whether PF should be deducted on monthly incentive payments (which is not fixed, which is calculated on particular dept's and overall company's performance in the particular month, varies month on month, with conditions of deduction of full incentive if leave exceeds above certain days, etc..). when following are complied pucca:-
1. Minimum wages / DA applicable complied.
2. Balance portion of salary is divided into other allowance such HRA, TA, WA, CCA, etc. PF deducted in the basic.

Dear Sirs,
Was there any response from PF commissioner (Compliance) To Mr. H.L. Kumar's Letter. It seems that the controversy still continues. Further, some states split the minimum wages themselves in 2 parts namely Basic and dearness allowance. In such cases is it correct to account only the basic wages for calculation of PF deductions?
Thank you all in advance for a clearing my above doubts.

Dear sir,
Letter of Sh. Kumar is itself a proof that matter is subjudice & the views of various high courts are also differ time to time in my openion we have to follow the circular or directive form epfo as enclosed by Mr. Alam in the begining rather to impose proceeding u/s 7a by ourself.

sir i have a clarification
my company is an ites company registered to west bengal shops and establishment act 1963. its a pvt ltd company.my basic salary is 4500 hra is 1080
city allowence is 1260 and conveyence allowence is 1260.
sir i do have do clarification how the salary is calculated
i am not understand sir please help me

Dear aslam,
As far as my little knowledge is concern , i can only say that Basic should be kept 50%-60% of the gross salary, but it should not be less than than the minimum wages of the state HRA should be 30%-40% of the basic, conveyance should be kept Rs. 800/- above than that should be taxable, medical allowance should be Rs. 1250/- above than that should be taxable, and rest should be put under other allowances.

sir i would like to know that from when it was made mandatory by the government that the basic salary cannot be less than the minimum wages of the state.please specify the date if possible.

Dear all,
Greetings for the day,
Earlier Jawed saab posted the clarification not to split the minimum wages for the epf purpose,many of us including myself personally agreed on the same . But in the same matter there was an scan copy of judgement by Sh. Balaji was posted which is also true and afterwards clarification from the EPF dept. was also received which is enclosing for the reference . In this reference i spoke to epf dept official they also said matter is subjudice in Honb'l Supreme court of india let them decide my question is to all my senior & fellow colleouges that where we go, to split the same (minimum wage) or can't split the same. Dear Jawed Saab Kahan hain AAP Bhool gaye kya.
