Can we allow the children who are blow 6 months of age ??
in act it is mentioned that creche is for the children who are under the age of 6 YEARS ... but somewr I have seen that, it is 6 MONTHS to 6 YEARS....
pls let me no if there is any minimum age required for the children??

There are detailed provisions for exemptions
These are provided in the Factory Rules of each state.
So it depends on which state you are in.
Maharashtra has 4 conditions for exemption,
Karnataka has only 2 conditions, the rest the factory inspector can give exemption, if there is alternate arrangement (eg shared creche) whose cost is paid by the occupier (factory / employer).

Dear HR collegues,
We are a Society, a separate legal entity and we deliver the CSR work of a Manufacturing company (factory) where there ia a creche. We have women employees more than 30.
Do we have to provide for a creche as a Society as we are not covered under factory act?
If yes then does the contractor/Principal employer must provide a creche of its own or can outsource to a private party?
If outsourced, is there any distance as per law the creche must be situated?

Creches to be provided where more than 30 women workers are employed and at least 15 are married or widow and more than 4 children-Under the factories act-Sec 48, RL 92
There is certain rule given under the RL 87/88/89 about how to build the creches and what food to be provide to the child.

Hi Do the staff in the creche facility come under CLRA, even if they are employees of creche service provider.

If the crèche is inside the factory premises, then the women working in the crèche will come under the contract labour rules. If the crèche is located outside the factory, then the definition will automatically exclude such employees of the service provider from the definition of contract worker as far as the factory is concerned

Kindly provide me the updated ACT on Company Creche. We want to construct a creche for our company female employees. I would like to know the Act implemented in Tamil nadu for Creche facility provision. Just want to have basic idea on creche construction and operating method. Please provide me the details.

Dear All,
With reference to the recent amendment in the Maternity Benefit Act 1961, with an insertion of Sec 11A, that "any establishment with 50 or more employees, should maintain a creche facility". Hence now it is a compulsion irrespective to only factories act .
