A showcause notice is issued when there is no clear cut prima facie misconduct. A show cause is an opportunity given to an erring employee to expalin his/her behaviour. A minimum time should be given for receipt of a written reply from the employee. Depending on the reply or non-receipt of the same further action can be initiated. This would be the chargesheet stage. Usually companies have their own set of dicipline rules which are called Standing Orders which govern such situations. In absence of any such well defined set of rules one may refer to the Model Standing Orders which are appended in any book of (even book of bare acts) Labour Laws.

Dear Jiten
1. Show Cause notice is not a legaly provisioned document and is used normally when the management wants to ascertain that the employee gets a message that the management will not tolerate the misconduct shown by the employee.
2. Chargesheet is the first step for conducting a domestic enquiry and establishes the connection between the misconduct and the rules and regulations applicable to the employee concern.
3. Charge sheet can be issued to any level of employee as rules and regulations are applicable to all the employees in the organisation.
4. Chargesheet should ideally be signed by the punishing authoirty / head of function. Normally the punishing authority is the appointing authority i.e. the person / s who sign the appointment letter.
