The Penality clause is applicable under Payment of wages act 1936.
Under Section 5 and sub section 3 it is clearly mentioned that Company below 1000 employees should pay salaries before 7th and above 1000 before 10th. There is a penality clause in this act.

My name is muthukumar working as Executive - HR & Admin in a reputed company. Neha you are working in a very worst company. Because they are not following the statutory provisions. That valid reason enough to pit your job.
Company must be follow the statutory provisions as per the State & Central Law & company policies. Otherwise the company will no longer survive in the market.
Please go for another good job. Otherwise explain the existing Laws to the management. They are not interest to take necessary action. If you continue the job. You will get depress a lot from Employer & Employee side

stiil i m not clear regarding working hours.
let me know under what conditions it is allowed to work for 12 hours?
and if 12 hours allowed then is company liable to pay over time?

Normally in Food Industry & Restaurants etc Employees will have have to work in peak hours like Chefs and kitchen team will work from 10:30 to 13:30hrs and they will be free again thay will have work from 18:00hrs to 21:00hrs based on level like Chef, CDP & Commi's.
The stewards/ Service team will have work from 11:30 to 15:00hrs and 19:00hrs to 22:30hrs.
When there is no work the staff can take rest obviously they will be working 12 hrs but in break shift.

please help me with this problem .I am Hr fresher i have joined a company recently(4 months) that i want to change to another company.Because hear they are not paying salary. Salary is not a big issue but they are also not add me in the PF and ESI that they are telling that they will take the employee in the PF and ESI after 11/2 year and no policies for employees.
so help me with this problem if i went to another company what i have to tell them what i have to.
