Dear Jastaran,
You are covered under ESI, hence you should claim under esi. and as per rules you can avail total 03 months leaves i.e. 1.5 months before expected date of Delievery and 1.5 months after the delievery.
Plz contact with nearest ESIC hospital to get more details and benefits.

Maternity Benefit Act is not applicable if employee is covered under ESI. In such case benefits shall be extended through ESI. Lokender Kumar

If your management says you are not eligibile for the maternity act, you can claim the same from the ESI. You can download the form from the net, get it signed from your employer and submit. ESI pays you for the same

The GR may be applicable to govt.establsishments in Maharastra. For establishmenst in private sector, the Govt. shall iamend the provision of teh Act and issue notification in the Gazette.However without seeing the GR, it is difficult to express an opinion.
