1.My initial designation was Software Engineer Trainee.
2. Every year along with my appraisal my designation changed(Software Engineer ,Senior Software Engineer,Senior Software Design Engineer,Technical consultant and Project Leader)
3.nature of work Sofware Developemnts
4. Company located in chennai.
5.No branches.
Additional information
1. No of employess 150+
2. Even in company reception area, they displayed Government Notices related to PF,Gratuity,Women maternity
3.for some employee who left with more than 10+exp company gave gratuity amount as an insentives after deduction tax(we came to know this personaly...because employer informed them not to disclose)

From the information furnished by you, you are entitled for gratuity under the Payment of Gratuity Act. A further scrutiny of the appointment orders given to you is necessary to calculate the length of service and the quantum of gratuity to which you are eligible. Depending upon the location of the Company you have to prefer a claim under the Payment of Gratuity Act before the Assistant Commissioner of Labour(Controlling Authority under the Payment of Gratuity Act) having jurisdiction over the area in which the Company is situate. As you have stated that the Company has no branches outside Tamilnadu your claim has to be preferred before the Assistant Commissioner of Labour of the Tamilandu State Labour Department.

I went to my HR Manager and requested to send a mail or a letter to the accounts department, but the HR replied back saying you have been given relieving letter keeping in mind for working for so many years. other wise you would have been given termination notice and sent. Please wait for 3-4 months for the matters to settle and i have to wait for PF forms also. we will send an email to you and sent me.
Now my question is should i wait for 3-4 months as told by my HR manager.
what is the minimum period to ask for gratuity and PF settlement.

Dear Member, Its your right to claim gratuity and you should apprach HR department. If they are not reposponding send them registered AD letter and you can also go in labour court. regards, Aparna

2.Subsequently was there any change in the designation given to you? If so please indicate the change and the date from which the change took place.
3.What was the nature of work done by you. Did it continue to be the same from the time of initial appointment until you left the company.
4.Where this company is situated?
5. Does it have branches in more than one State?
6.How many persons were employed by the Company? Was it at any time 10 or more?
7.What was the nature of work carried on by the company?
8.What was the date on which you were relieved from the Company's services?

Thanks Mr. Sethupathy. Your suggestions have helped me tackle my previous company management, and get my gratuity amount cleared. Though it took almost 5 months, but it happened.

Dear Sir,

I , Swagatam Sarkar worked as a Computer Operator in a C&FA of Hindusthan Uniliver Ltd from December,2006 to March,2012. I have worked there for 5 years and 4 months. I have left the job for a better job.

Recently I claimed my Gratuity and Arrear(Salary Increament) for the month from January,2012 to March,2012 to the C&FA owner, He completely refuses to pay any gratuity and arrear.

For the Gratuity, he told me I would be entitled to Gratuity if I was terminated by him, and I would not be entitled as I have left the job.

And for the Arrear ( salary increment) for the month from January,2012 to March,2012, he told me that HUL has increased the salary for the present staff. The increment will not be given to me as I am not the present staff. The salary is increased in the month of August,2012 and it is affected from January,2012. As I was employed for the month from January,2012 to March,2012, so I am entitled to Arrear.

I am totally confused now. I cannot understand what is the justification of claiming the gratuity and arrear?

In a normal point of view, my claim is justified and I have the right to receive my Gratuity and Arrear.



If I am really entitled to the Gratuity and Arrear, please help me.

I presume that the establishment in which you were employed is governed by the Shops and Establishments Act. Please indicate the number of workmen employed in the establishment. With regards

if a person is working from year 2000 and he was on leave (LOP) from last one year, and he resign after one year, SO FOR HOW MANY YEARS GRATUITY IS APPLICABLE?
