Dear Pradeep Anwar,

You have asked for a draft of the termination letter. Your company wishes to terminate a long-serving employee. However, please confirm to us why your company wishes to terminate the services of the long-serving employee. What was the nature of the misconduct? Did your company conduct the domestic enquiry to investigate the incident?

Any termination of employment has to be preceded by a domestic enquiry. Therefore, please provide us with complete information on whether or not the employee was issued with a show-cause notice, whether the domestic enquiry was conduct or not, what emerged during the investigation etc.

the termination of employment is a delicate issue, and it has to be handled with due sensitivity. If a proper procedure of employee discipline is followed, then it will send a signal to other employees that principles of natural justice are followed in your company. This will improve the standing of the company in the eyes of the employees. This is far more important than taking action against the employee, however, delinquent he/she may be.

Thanks,

Dinesh Divekar
