Dear Seniors,

I have query regarding ESIC & MB act. please clear my confusion giving by solutions with any judgement.

there is 1 employee she joined us 5th Oct-2020 and she was pregnant at the time of joining(3.5 month) and we covered her under ESIC act as her salary 21K.

her Expected delivery date is Feb end 2021

now my question is that is who will the salary to her for 26 weeks. as I contact local Esic department they said she is only eligible to medical benefit not cash benefit from the ESIc because IP should be 9 month old.

now company have to pay salary ? if yes then why ? because company already covered her in ESIC and company is giving contribution esic if she is not qualifying the norms of Esic then it is not company fault.

or

if company doesn't have to pay salary in this case this the loss of an employee because esic has denied and company also will denied .

please give me your suggestion i hope you got my point if is there any confusion please let me know.
