Dear Sir,

In view of phase-wise lock-down and relaxations, the appropriate governments are allowing the industries to run with less manpower (onrolls and contract) in Green / Orange Zones. If the local administration allows to run the industry with 33% manpower what is the legality on this matter as mentioned below:

1) Out of 1000 manpower, we can allow 333 manpower for duty. What about the payment of PF / ESI contributions for 637 manpower?

2) How many manpower to be shown for generation of PF / ESI challan?

3) What is the liability of employer to pay salaries / wages for 637 manpower as they have not worked at work place or work from home?

4) What is the impact of Non-working man-days in lock-down while calculating Annual Leaves, Annual Bonus and Gratuity?

Kindly clarify the above points.

Employees on Muster-Roll of an Establishment do not Ceas to be Employees during Covid-19 Clamp-Down/ Lock-down by mere Executive Orders restricting the Employers to allow Certain or some of them. Thus, the Benefits of PF etc ought to continue and as far as Computation Of Leave Period is concerned, the Employers, affteced by the Executive's Order, ought to Seek & Secure Clarity from the Enforcement Authorities.
Such Employees who are debarred from Reporting to their respective WorkPlaces to resume thei Normal Duties they were Hitherto Discharging need not be Penalized. This is my take
