Request your advice on the following situation. An employee of an Small Real Estate company had worked for 1 month and resigned during the probation period giving notice of 2 weeks .wheras as per Appointment terms 30 days notice during probation.
His resigned from the job after working 30 days ,proprietor did not respond to his resignation or Releaving him.
because there was not response from the employer he handed over the work to his subordinate.
Now the employer has kept hold His Salary and not responding to the employee. In total The employee has worked for 30 +13 Days.
Can the employee approach the Labour Dept. and Demand the His settlement.?
Can the employer hold stating that the resignation was not accepted?

Yes, employee can ask for his settlement. Resignation is not accepted can not be the reason for holding back the salary. If employee had served 2 weeks notice period then pending days of notice period can be recovered from the employee and pending due amount for employee should be settled.
