Dear Concern, 20 days ago i got offer letter from One company for joining. After confirmation/Offer letter from company i resigned from my current company but when i went for joining they refuse me and tell me that ,this time position is on hold. I was shocked how company can deny joining after confirming me through mail.this time i am stuck and very much in dilemma i don't have any job right now.i am the only earning person in my family and this time nothing in my hand..what should i do???? Can i take legal action on it ???

Its in fact unfortunate that the Company is now denying to take U on Board after issuance of Offer Letter, since the position has been put hold. Such tactics are sometimes adopted by by Companies owing to uncertainties in Job Market. But no duobt Candidates' Careers are affected due to htese tactics
Definately U have the right approach the Court of Law, but again its quite Time Consuming & will be creating lot of stress in addition to financial burden also. Now its upto ur Choice to chosse which way to go. One way is to concentrate on search of a new job thro' walk-ins or sit on their head, create some pressure on the Company to fulfill their commitment. Here again the some hidden disadvantages may be there.
Now its upto U to choose ur course of action & act as per ur own wisdom. Of Course, we can help U with some of the job openings in case, if U so desire.

Hello Diwakar,
Another option would be to GO BACK to your earlier Company & rejoin on the same salary as earlier.......suggest DON'T go for ego hangups.
IF your performance & exit have been good, there shouldn't be any problem.....UNLESS they filled-up the position.

I have the same opinion as Satheesh.
Legal action won't help to address your problem of immediate employment.
Try to go back to original company.
Don't loose heart you will definitely get an employment.

Thanks for your suggestion.
I am searching new job also but i can't leave the company who is playing with my career. what is the disadvantage if i take legal action on company.i am sitting jobless at home and company is not even replying me after sending 2-3 mails.

Let's understand the legal aspect.
The company gave you an offer letter.
I assume you have it in hand.
Did you give a written confirmation ?
Do you have an acknowledgment or proof of the same ?
Was the confirmation given within the time limit specified in the offer letter ?
If you don't, to any of the above, there is no contract and the company owes you nothing.
If you have all the above, the contract stands and the company must honour it.
But what does it mean ? Can they be forced to employ you ?
Actually no. Instead they can be asked to give you compensation. Which would be equal to what they would have to pay you for working with them. That sounds good on paper. But what is the notice period ? Cause they can recruit you and immediately give termination notice right ? So the compensation would be equal to the amount of notice pay. And in most companies notice period is zero during probation. So you get nil.

But i can't back to my original company because when i resigned company found the replacement.and i handed over to new joinee.
So,No chance at this moment..
now i am searching new Job this is the only way i think.
