Can 2 workers from the same family (eg. husband and wife) working in the same factory be entitled for ESI separately? Is there any legal care that one should take in this regard?

Dear Deeparayncyan, What about their ESI deduction? If you deduct their ESI then obviously they are eligible for the ESI facility. Thanks, Dinesh Divekar

1. Sir, social security benefits viz.benefits under ESI Act, 1948 are payable as a result of contributions of individual employees and their eligibility on the basis of such contributions. If two insured persons, who are related to each other (husband or wife, or brother or sister etc.) are working in the same unit, it make no difference.
2. Husband and wife, if both are working in the same organisation and if both covered under ESI, will get their benefits separately as and when such occasion arises depending on basis of rates as applicable. However, wife or sister being insured woman will also be entitled for maternity benefit.

There will many such cases of husband and wife both being IPs due to being employed in some firm which comes under ESIC.
