We have received an anonymous complaint on sexual harassment. an email has been created and reported a complaint on another employee. The person does not want to reveal his/her identity but wants us to take action. Watsup screenshot has been sent as proof.
Do we have to act on the complaint without the identification.

An initial inquiry has to be conducted and findings are to be kept in records of the company. Anonymous complaints on sexual harassment, graft, malpractices in the transactions cannot be ignored.

Dear Suman,
Please check the policy on Prevention of Sexual harassment. If it allows you to entertain anonymous Complaints, go ahead and take action. Otherwise, please reply to that mail stating that no action can be taken on anonymous complaints and the person should come out in the open and complain so that the proper procedure can be followed.
Further, Whatspapp messages are a good proof of an offence.
However, it would be prudent to make an inquiry (official or unofficial) if the case has been reported in the organization.

In view of Madras HC decision in Mr. Bader Sayeed v Southern India Education case decided on 3.8.2012, no action should be taken on anonymous complaint in sexual harassment case because there is no complainant to prove the complaint.

dear friend,
the complaint either anonymous or pseudo anonymous certainly give some hidden proof through whatapp, primafacia there exist some abnormal activities, in particular the specific of sexual harassment certainly would not come open floor to prove. Even purchases, bribes will not come open, some whistle blowing or another way is the only possibility, as there is always misuse of power and authority, every one is bound to seek an another way of getting the proof for cleansing of organisation, this will also help the authorities to know the real skin of the person. In fact, we can know the person only when he/she is alone, the alone is the criteria two minds plan to do something in a singular way, this sometimes prove fatal, as the other mind did not cooperate and bring the facts to the shore, so there is no single mind exist to make or disrepute an organisation..in all the way look into the issues and sort out where the ugliness sit..the initiation in itself bring a lot of facts to the shore...

It is better to pursue remedy under IPC through an NGO than to get the action under the said Act stalled because of procedural lacunae.
