We are a Propretorship Firm registered with SHOP & Establisment Act with 8 Employees in Delhi HO and 6 Employees are in Gurgaon Branch.
Can we are coverable under ESIC ACT with under section 1 (5)or 2 (9)
Please explain and help us because ESIC Department enforced us for cover

Hello
ESIC Act is applicable to all factories employing 10 or more workers. Its applicability for Shops & Commercial Estab may vary State to State. Like in Maharashtra, it is 20. This includes all employees whether at different or same locations, whose salary is less than equal to Rs 15000.
Therefore please check the State Government Notification for both Delhi & Gurgaon.
If the ESIC authorities are demanding coverage, they must have some notification to prove it too.
Also request you to upload the same for the benefit of HR community.

Dear Sir,
Thank you for your response.
We have already checked state govt notification and the said notification is applicable to us since 1st April 2011 if we have 10 or more employees under one State.
ESIC Department demanding coverage on basis of his revenue manual (attached for your reference). They advised us for coverage from 1st April 2011 after clubing of our Bracnh office employees.
Is it right?

Hello In your case, they are right as per the manual since your Head Office is in an implemented area while branch office may or may not be in an exempted area. Therefore covered. regards
