what penality labour authority can imposed maximum under payment of wages act if employer is pay delay payment and do unauthorized deduction under payment of wages act .

Dear Paramjeet Payment of wages authorities can impose a penality which may be imposed maximum 10 timesof delayed wages or unauthorised deduction.please refer section 15 of payment of wages act 1936.

True that the Payment of Wages Act prescribe for 10 times penalty but I have seen that in most of such cases the respective High Courts have termed 10 times penalty as un-justified. Generally the courts have justfied 3 or 5 times penalty depending upon the circumtances.

Just wanted to know whether the person who is in a Senior post ( D.G.M.) and company has not paid his full and final dues. Can he file a case against company under the payment of wages act ? does he come under that ?
